These Terms of Use ("Terms") govern your use of Tripw, the trip-planning app for iPhone and the website https://tripw.co (together, the "Service"), operated by the Tripw team ("we", "us"). If you have any questions, contact us at support@tripw.co or through our support page at https://tripw.co/support.
Accepting these Terms
By creating an account or using the Service, you agree to these Terms. Our Privacy Policy explains how we handle personal information and forms part of how the Service works. If you do not agree to these Terms, please do not use the Service.
The Service
Tripw helps you plan trips and travel together with others. You can create trips, invite members, build a daily schedule, keep flights, hotels and travel documents in one place, split expenses, run polls, chat, share photos and videos, and prepare packing lists. Some features are available only with a Tripw Plus subscription. We may add, change or remove features over time.
Your account
- You must be at least 13 years old to use the Service, or 16 if you live in the European Union. If you are under the age of legal adulthood where you live, you may use the Service only with the involvement of a parent or guardian.
- Give accurate information when you sign up and keep it up to date.
- Keep your password confidential. We recommend turning on two-factor authentication.
- You are responsible for activity in your account. If you suspect someone else has access to it, tell us right away.
- Your account is personal. Do not share it or let others use it.
Shared trips
Trips in Tripw are shared spaces. Trip members see each other: names and profile photos, the schedule, flights and hotels, expenses, comments, polls, the packing list, photos and videos, and documents marked as shared. Anyone with a trip's invite code or link can join it, so share it only with people you want in the trip.
You decide what to upload and what to share, and you are solely responsible for the content you add to a trip and for sharing it, including other people's details. Before uploading documents or personal details of someone else, such as a fellow traveller's or a child's passport, make sure you have their permission.
Trip members are responsible to one another for the information they share and for how they use what other members shared. Tripw provides the tools for sharing but is not a party to what members decide to share with each other and does not review the content.
The trip owner manages the trip, including its members and settings. Tools such as expense splitting help members keep track, but they are not a financial or accounting record. Any disagreements between members are theirs to resolve.
Identity documents
Passports, visas and insurance are kept private by default: only the member who uploaded them and the members they are assigned to can open them. Sharing such a document with all trip members happens only through the "Share with the members" switch; it is the uploader's explicit choice and their sole responsibility. We record who confirmed the sharing and when.
We recommend not sharing identity documents unless necessary. Whoever shared a document can stop sharing it at any time by editing it; from then on it is private again, but copies other members already saved to their devices are outside our control. Tripw does not review the contents of documents and is not responsible for how trip members use a document shared with them.
Location sharing
The live map lets you share your location with the trip's members. Sharing is off until you explicitly agree to it, separately for each trip. While sharing is on and the app is open, your approximate location is shown to that trip's members only, and only around the trip's dates. You can pause or stop sharing and withdraw your consent at any time from the map or the profile settings; a location is deleted after 24 hours and the sharing record a week after the trip ends, as described in the Privacy Policy.
Choosing to share your location is your decision and your responsibility. The location comes from the phone's sensors and may be inaccurate; don't rely on it for safety or to find a person.
Your content
You keep ownership of the content you add to the Service. You give us a limited, non-exclusive, worldwide, royalty-free licence to host, store, copy, display and process your content only as needed to operate and provide the Service to you and to the members of the trips you share it with. This includes, for example, showing places on a map, translating descriptions, creating offline copies and sending content to the AI provider when you ask to use an AI feature.
This licence ends when the content is deleted from the Service, except for copies kept in backups for a limited time and content that other members have already saved. You confirm that you have the rights needed to share the content you add.
Our rights
The Service, including its software, design, texts and brand, belongs to us or our licensors. We give you a personal, limited, non-exclusive and non-transferable licence to use the Service in line with these Terms. Nothing in these Terms transfers any of our rights to you.
Acceptable use
When using the Service, you agree not to:
- upload or share unlawful, offensive or infringing content, or content that violates someone else's privacy;
- upload other people's documents or personal details without their permission;
- harass, threaten or abuse other users;
- access other people's accounts or trips without permission;
- scrape, copy or collect data from the Service by automated means;
- reverse engineer, decompile or try to extract the source code of the Service, except where the law allows it;
- try to bypass usage limits, subscription checks or security measures;
- interfere with or overload the Service, or use it to spread malware or spam;
- use the Service for any unlawful purpose.
Tripw Plus and free trials
- Tripw Plus is offered as weekly, monthly and yearly auto-renewing subscriptions, purchased through the Apple App Store.
- Where offered, a free trial is available on your first purchase. When the trial ends, the paid subscription starts unless you cancel beforehand.
- The price is shown in the App Store before you buy and is charged to your Apple ID account.
- The subscription renews automatically at the end of each period unless you cancel it at least 24 hours before the current period ends.
- You can manage or cancel the subscription in your Apple ID subscription settings. Deleting the app or your Tripw account does not cancel the subscription.
- Refunds are handled by Apple under its own policies.
- A trip owned by a Plus subscriber gives its members Plus features inside that trip.
- The free tier has limits, for example on the number of active trips, trip length and number of members. We may change these limits and the features included in each tier.
AI features
Tripw Plus includes AI features, such as importing bookings, planning a day, scanning receipts, reordering a day, suggesting polls, checking documents and creating packing lists. Please keep in mind:
- AI results are suggestions. They are shown for your review, and you decide what to save.
- AI can make mistakes. Check every detail, such as times, dates, amounts, names and booking numbers, before relying on it.
- The AI features do not provide professional, legal, visa, immigration, medical or financial advice. For those, consult the relevant official source or professional.
- Each AI feature has monthly usage limits, which may change.
Third-party services and bookings
Tripw is not a travel agent. We do not sell flights, hotels or tours, and we are not a party to any booking you make with an airline, hotel, tour operator or other provider.
Attraction listings come from Viator (a Tripadvisor company). If you choose to book, you are taken to Viator's site, and the booking is made there under Viator's terms. Questions about a booking, its payment, changes or cancellation should be directed to Viator or to the relevant provider.
The Service works with third-party services, such as map apps, sign-in providers and weather services. Your use of those services is subject to their own terms, and we are not responsible for them.
Travel information
Information shown in the Service, such as flight times, weather forecasts, opening hours, attraction details, document expiry reminders and entry requirements, may be incomplete, out of date or inaccurate. Before you travel, always confirm important details with official sources, such as your airline, hotel, the relevant embassy or government authorities. You are responsible for holding valid travel documents and meeting entry requirements.
Availability and changes
We work to keep the Service available and reliable, but it may sometimes be unavailable because of maintenance, updates or problems outside our control. Offline copies on your device may not include the latest changes made by other members. We recommend keeping your own copies of important travel documents. We may change, suspend or discontinue parts of the Service. If we discontinue the Service entirely, we will try to give reasonable notice.
Ending your use of the Service
You can stop using the Service at any time and delete your account from the profile screen in the app. If you have a Plus subscription, cancel it separately in your Apple ID settings.
We may suspend or close an account if it breaches these Terms, puts other users or the Service at risk, or if the law requires it. Where reasonable, we will notify you and explain why. Sections that by their nature should continue after the account is closed, such as disclaimers, limitation of liability and governing law, will continue to apply.
Disclaimer
To the extent permitted by law, the Service is provided "as is" and "as available". We do not promise that it will be uninterrupted, error-free or suitable for every purpose, or that information in it will always be accurate or complete.
Security, misuse and outages
We take reasonable, industry-standard measures to protect the Service and the information in it, such as encryption in transit, access controls, two-factor authentication for administrators and monitoring. No online system is completely secure, however, and we cannot guarantee that the Service will never be breached, misused or disrupted.
To the extent permitted by law, we are not liable for damage, loss or loss of data caused by:
- unauthorised access to the Service, its servers or accounts, hacking, cyber-attacks, malware or denial-of-service attacks carried out by a third party despite our reasonable security measures;
- misuse of the Service by other users or third parties, including use of content or information you shared in a trip, impersonation, fraud and phishing attempts;
- use of your account by someone who obtained your sign-in details or access to your device;
- failures, outages, delays or data loss at our servers, networks, hosting, cloud and communications providers, the app stores or third-party services the Service relies on, as well as maintenance and upgrades;
- circumstances beyond our reasonable control, such as power or communications outages, natural disasters, war and terrorism.
You are responsible for keeping your sign-in details confidential, turning on two-factor authentication where available, protecting your device, and keeping copies of essential documents outside the Service (for example passports and boarding passes). If you learn of any unauthorised use of your account or a security breach, tell us right away at support@tripw.co.
If we learn of a security incident that may affect your personal information, we will act to limit the harm and notify you and the authorities as the law requires. This section is subject to "Limitation of liability" and does not limit any liability that cannot be limited by law.
Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for loss of profits, data or opportunities, including missed flights, denied entry, or bookings lost or cancelled, arising from the use of the Service. To the extent permitted by law, our total liability for any claim relating to the Service is limited to the amount you paid for the Service in the 12 months before the event that gave rise to the claim.
Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud, or for death or personal injury caused by negligence.
We are not responsible for content users upload or share in a trip, including identity documents and locations shared by a user's choice, nor for how other trip members use such content. Responsibility for shared content and its consequences lies with the user who shared it and with the trip members between themselves.
Indemnity
If a third party brings a claim against us because of content you added to the Service or because you breached these Terms, you agree to compensate us for reasonable losses and costs resulting from that claim, to the extent they were caused by you. We will let you know about any such claim and allow you to take part in handling it.
Apple App Store
If you downloaded the app from the Apple App Store, the following also applies:
- These Terms are between you and us. Apple Inc. is not a party to these Terms and is not responsible for the Service or its content.
- Your use of the app must also comply with the App Store Terms of Service. Apple's standard Licensed Application End User License Agreement applies alongside these Terms where relevant; if there is a conflict, these Terms apply to the extent permitted.
- Apple has no obligation to provide maintenance or support for the app. Support is provided by us.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any. To the extent permitted by law, Apple has no other warranty obligation for the app.
- Apple is not responsible for handling any claims relating to the app, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, consumer protection claims, or claims that the app infringes third-party intellectual property rights.
- You confirm that you are not located in a country subject to a U.S. Government embargo and are not listed on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will let you know in the app or by email before they take effect. If you keep using the Service after the changes take effect, the updated Terms apply. If you don't agree to them, stop using the Service and delete your account.
Governing law
These Terms are governed by the laws of the State of Israel, and the competent courts in Israel will have jurisdiction over any dispute relating to them. Nothing in these Terms limits rights you have as a consumer under mandatory law in the country where you live.
General
These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service. If any part of them is found to be unenforceable, the rest remains in effect. If we do not enforce a right, that does not mean we waive it. You may not transfer your rights under these Terms without our consent. We may transfer ours as part of a merger, acquisition or sale of the Service.
